These Terms & Conditions ("Terms") govern the provision and use of internet and broadband services ("Service") supplied by Cybernet Introtech ("Cybernet Introtech", "we", "us", "our"), operating under an ISP Category C licence, to any subscriber ("you", "the Customer"). By subscribing to, activating or using the Service you agree to these Terms.
1. Definitions
- Service - the wired / fibre-grade internet access provided at the Customer's registered premises.
- CPE - Customer Premises Equipment such as the router, ONT/ONU, modem or media converter used to deliver the Service.
- Plan - the tariff, speed and validity agreed at the time of subscription or renewal.
2. The Service
- Speeds quoted are the maximum achievable up to our ISP node and are delivered on a best-effort basis as per TRAI guidelines. Actual throughput may vary with network conditions, in-home wiring, Wi-Fi, and the Customer's device.
- Usage figures include both upload and download data unless stated otherwise.
- We may carry out planned maintenance or upgrades that temporarily affect availability; we will make reasonable efforts to give advance notice.
3. Eligibility & KYC
- The Service is available only where our network reaches the Customer's premises, subject to feasibility survey.
- As required by the Department of Telecommunications (DoT) licensing conditions, the Customer must provide valid Know Your Customer (KYC) documents and accurate identity, address and contact details before activation.
- You are responsible for keeping your account and contact information current.
4. Installation & equipment
- CPE provided by Cybernet Introtech remains our property unless expressly sold to the Customer, and must be returned on termination if supplied on a rental / deposit basis.
- The Customer shall keep the CPE safe and shall bear the cost of repair or replacement for loss or damage caused by misuse, tampering or negligence.
- The Service and CPE are for the Customer's own use at the registered premises and must not be resold or redistributed without our written consent.
5. Fair & acceptable use
- The Service must not be used for any unlawful purpose, to infringe others' rights, to send spam, or to compromise network security.
- We may apply reasonable network-management measures to protect service quality for all customers.
- We may suspend or restrict the Service where usage threatens network integrity or violates law or these Terms.
6. Billing, payment & renewal
- Charges, speed and validity are as per the Plan agreed at subscription or renewal. Applicable taxes apply as per law.
- The Service is generally prepaid; access continues for the validity of the active Plan and requires renewal to continue thereafter.
- Amounts paid are non-transferable and, save as required by law, non-refundable once the Service has been activated for the billing period.
7. Suspension & termination
- We may suspend or terminate the Service for non-payment, breach of these Terms, or where required by a competent authority or by our licence conditions.
- Either party may terminate the Service with reasonable notice. On termination, any Cybernet Introtech-owned CPE must be returned.
8. Regulatory compliance
- The Service is provided subject to the Indian Telegraph Act, the Information Technology Act 2000, TRAI regulations and the conditions of our DoT ISP licence.
- We are obliged to cooperate with lawful requests from authorised government and law-enforcement agencies, including lawful interception and the retention and disclosure of records as required by law and our licence.
9. Limitation of liability
- To the extent permitted by law, Cybernet Introtech is not liable for indirect or consequential loss, loss of business, or loss arising from interruptions, delays or failures of the Service beyond our reasonable control (including force majeure, upstream / power / cable faults).
- Our total liability for any claim relating to the Service shall not exceed the charges paid by the Customer for the affected billing period.
10. Changes to these Terms
We may update these Terms and our Plans from time to time. Material changes will be published on this website. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Muzaffarpur, Bihar.
